Terms of Service

TERMS AND CONDITIONS
of the trader Glowsome s.r.o., Company ID: 09021965, registered office at U žlábku 174, Praha 5, 155 31
1. GENERAL PROVISIONS
1.1. These terms and conditions (the “Terms and Conditions”) of the trader Glowsome s.r.o., Company ID: 09021965, with its registered office at U žlábku 174, Praha 5, 155 31 (the “Provider”) govern, pursuant to Section 1751(1) of Act No. 89/2012 Coll., the Civil Code (the “Civil Code”), the mutual rights and obligations of the contracting parties arising in connection with or on the basis of an agreement for the provision of services in the field of marketing (the “Agreement”) concluded between the Provider and another natural or legal person (the “Client”) by means of a form on the Provider's website operated at the internet address www.lucierust.com (the “Website”), or, as the case may be, in the printed form of this form.
1.2. The provisions of the Terms and Conditions form an integral part of the Agreement; by concluding the Agreement, the Client agrees to these Terms and Conditions and declares that it had the opportunity to become acquainted with them before its conclusion, these Terms and Conditions being available on the Website. The Agreement and the Terms and Conditions are drawn up in the Czech language.
1.3. The Provider may amend or supplement the wording of the Terms and Conditions. This does not affect rights and obligations arising during the period of effectiveness of the previous wording of the Terms and Conditions.
1.4. The Provider is an expert in the field of advertising activities, consulting, consultations, marketing, and related photographic, audiovisual and similar services.
1.5. The Client hereby declares that it concludes the Agreement with the Provider either as a consumer (that is, as a natural person who, outside the scope of its business activity or the independent exercise of its profession, concludes the Agreement with the Provider or otherwise deals with it, hereinafter the “Consumer”), or as a business (that is, as a person who concludes the Agreement within the scope of its business activity or the independent exercise of its profession, or in connection with such activity, hereinafter the “Business”). The Client shall indicate its status when completing the form under point 1.6; provisions of these Terms and Conditions intended expressly for consumers apply only where the Client is a Consumer.
1.6. On the basis of the Agreement, the Provider provides the Client with the services selected within the scope of the Agreement (that is, the services selected in the electronic form on the Website, or, as the case may be, in the printed form of this form), the individual services offered being described in more detail in the form which constitutes the Agreement, including their scope and price. These services consist chiefly of the educational and mentoring programme The Reconnection Project, focused on the area of romantic relationships, delivered through an online course, workbooks and materials, live group sessions, and individual consultations of a psychotherapeutic and coaching nature, or, as the case may be, through stand-alone individual consultations not linked to the course (the services provided hereinafter the “Services”).
The basic programme includes:
— LEVEL #1: self-awareness, working with self-reflection
— LEVEL #2: the 4 phases of a relationship and how we move through them
— LEVEL #3: self-regulation and co-regulation
— LEVEL #4: how intimacy and body-based work fit into this
— Live sessions on Zoom calls
— Workbooks
— Practical illustrations of relationship principles using the 3-Identities model
— Individual sessions for VIP participants
Forms of cooperation
— VIP cooperation – the Client has access to live sessions as well as individual consultations (up to 5 individual consultations over the duration of the basic programme, i.e. 4 months).
— Premium cooperation – the Client goes through the mentoring programme accompanied by live sessions.
1.7. Depending on the scope chosen within the Agreement, the Services may consist solely of the one-off provision of a service (for example, a single individual consultation outside the scope of the programme, such a service hereinafter a “One-off Service”), or of a comprehensive programme provided for the agreed duration of the cooperation under point 2.2 (that is, the basic programme or the advanced comprehensive cooperation, comprising in particular access to the online course, workbooks, live sessions and, as the case may be, individual consultations), such services hereinafter the “Recurring Services”.
2. DURATION OF THE AGREEMENT AND PAYMENT TERMS
2.1. The Agreement is concluded at the moment the Client's completed form is confirmed as received (accepted) by the supplier. The confirmation of receipt (acceptance) will include a summary of the details of the Agreement, the specification of the Services, and these Terms and Conditions attached once again.
2.2. The Agreement is concluded according to the chosen scope of Services, for the duration of the provision of the One-off Service, or for the period during which the Recurring Services are provided.
The duration of the cooperation is set as follows:
— Basic programme – lasts 4 months, unless otherwise agreed in writing when the cooperation is concluded.
— Advanced comprehensive cooperation – lasts 12 months, unless otherwise agreed in writing when the cooperation is concluded.
The duration of the cooperation is stated on the invoice or other confirmation of the order.
2.3. The Client undertakes to pay the Provider the amount corresponding to the selected Services under the Agreement. For Recurring Services, this will be either an amount for the entire chosen period of provision, or an amount for each month of provision of such Services, and for One-off Services it will be an amount for the relevant service (the amount for the entire period, the amount for the first month of provision of the service, and the amount for One-off Services, hereinafter the “First Payment”). Where, for Recurring Services, payment is not made for the entire period of provision, the Client undertakes to pay, before the start of each further calendar month, the amount corresponding to the price of the Services for the following month (the following amounts hereinafter the “Subsequent Payments”).
2.4. The First Payment is due on the day the Agreement is concluded. The Client shall pay the First Payment in accordance with the Agreement, as a rule by online payment by payment card (hereinafter the “Payment Card”), unless expressly agreed otherwise in the Agreement.
2.5. If the First Payment cannot be made by Payment Card, the Provider is entitled to send the Client payment details for making the First Payment by bank transfer, consisting in particular of the Provider's account number and a variable symbol, unless the contracting parties agree otherwise.
2.6. Subsequent Payments are due no later than the beginning of the calendar month for which payment is being made. Subsequent Payments may be debited automatically from the Client's bank account. If a Subsequent Payment cannot be debited before its due date, the Client is obliged to pay it without delay on the basis of payment details communicated at its request.
2.7. The Provider shall send the Client confirmation of receipt of any payment by e-mail, including the relevant tax document.
2.8. Payment of the First Payment is a condition for the Provider commencing any activities whatsoever. If the Client is in delay with the payment of any Subsequent Payment or any other payment arising from the Agreement, the Provider is not obliged to provide any Services for the duration of such delay.
2.9. The provision of Services shall commence once the supplier contacts the Client — either by proposing an initial consultation on the basis of which a schedule and plan for the provision of the Services will be drawn up, or by proposing such a schedule or plan directly. For a One-off Service, this may consist solely of a communication of possible dates for provision of the service. Contact shall take place via the contact details provided by the Client in the Agreement (such contact hereinafter a “Proposal for Performance”). If a Proposal for Performance is not made within two (2) weeks of payment of the First Payment, the Client has the right to withdraw from the Agreement with a claim to the return of performance already provided, except for amounts corresponding to Services already provided, if applicable.
2.10. The Client is obliged to provide maximum cooperation for the provision of the Provider's Services, in particular by supplying relevant materials and cooperating in agreeing dates for the provision of Services.
2.11. If, during the term of the Agreement, not all Services forming part of the purchased service are used — whether, for example, due to a subsequent agreement of the contracting parties or the Client's failure to cooperate — the Client has no right to claim performance after expiry of the Agreement, nor any right to a refund of any part of the funds paid to the Provider on the grounds that Services were not provided.
3. QUALITY OF SERVICES AND GUARANTEE
3.1. In providing the Services, the Provider is obliged to have regard to the Client's good name and to provide the Services with professional care and at a professional standard of quality.
3.2. The Client expressly acknowledges that the Provider is not responsible for the specific results the Client achieves within their personal life or romantic relationship. The Provider cannot influence how the Client makes use of the materials, recommendations and procedures provided, nor the decisions, behaviour or willingness to cooperate of the Client's partner. The Provider therefore does not warrant, and cannot warrant, any specific outcome — for example, resolving a specific relationship issue, improving communication between partners, or preserving the relationship — since such outcomes are not determined by the Provider alone, but above all by the Client's degree of engagement and the conduct of both partners. The Provider's Services are not a substitute for professional medical, psychiatric or crisis care and are not intended to address acute crises (for example, domestic violence, serious mental illness, or immediate danger to safety); in such cases the Client is obliged to seek appropriate professional help.
3.3. If the Client is not satisfied with the provision of Recurring Services that were meant to be capable of improving their relationship dynamics, or their ability to manage recurring disagreements with their partner, and such improvement has objectively not occurred due to insufficient quality of the Services provided, the Client is entitled to terminate the provision of Services earlier than agreed — but not earlier than after three (3) months of provision — without any obligation to pay for the remaining months (the remaining Subsequent Payments). If the Client paid for the Recurring Services in advance for the entire period, a proportionate part of that payment will be refunded, corresponding to the months for which Services will no longer be provided (all of this hereinafter the “Quality Guarantee”).
The Client is entitled to a refund within the statutory period of 14 days, provided that I extend this period to 30 days subject to the following conditions:
— The Client actively works on their relationship,
— Completes all tasks in the programme in full,
— Attends all joint consultations,
— Follows the recommended strategies and methodology of the programme,
— Regularly reports their progress and submits assignments,
— Provides feedback and discusses their progress with me.
The Client must be able to demonstrate fulfilment of the above conditions (e.g. submitted assignments, attendance at consultations, feedback, etc.).
If the Client breaches the conditions of the cooperation, they lose their right to a refund. This applies in particular to situations where the Client:
— Fails to follow the set procedures and does not complete assigned tasks,
— Ignores instructions and recommendations,
— Does not attend consultations,
— Breaches the rules of the programme,
— Acts on their own initiative and disregards the recommended process, thereby jeopardising the effectiveness of the cooperation.
The Provider reserves the right to individually assess whether the Client has met the conditions for recognising the guarantee.
3.4. The Client is obliged to assert any complaints or defects in writing within five (5) days of the day on which the defect could, with due care, have been discovered, but no later than within six (6) months of the provision of the service. On expiry of either period, the Client's right lapses.
4. LICENCE TO WORKS AND OWNERSHIP
4.1. The contracting parties expressly acknowledge that, in the course of the Provider's activity and that of its potential subcontractors, copyright works may arise within the meaning in particular of Act No. 121/2000 Coll., on Copyright, on Rights Related to Copyright and on the Amendment of Certain Acts, as amended (hereinafter the “Copyright Act”), in particular photographic and audiovisual works, but also textual and other works.
4.2. Pursuant to Section 12 of the Copyright Act, the Provider hereby grants the Client a non-exclusive licence to use works created in connection with the provision of the Services (in particular workbooks, recordings, and other educational materials), for the Client's own personal use only. The Client is not entitled to distribute, make available, copy or provide these works, any part of them, or any materials derived from them, to third parties in any way, whether for payment or free of charge, nor to grant sub-licences or otherwise assign rights under this licence, and is likewise not entitled, without the Provider's prior written consent, to interfere with, alter or otherwise modify the works.
4.3. If the Quality Guarantee under point 3.3 is invoked, the Client loses the rights under the licence referred to above and is obliged, without undue delay, to stop using the materials and works provided and to delete them from its devices and storage.
5. PROTECTION OF INFORMATION
5.1. The contracting parties undertake to keep confidential any information and reports relating to their own cooperation and the internal affairs of the contracting parties, where their disclosure could harm the other contracting party.
5.2. Confidential information also includes all information mutually provided in any objectively perceivable form — whether orally, or in documentary, electronic, visual or other form — as well as know-how, which has actual or at least potential value and which is not commonly available in the relevant business circles, or which, by its nature, may be presumed to be confidential or subject to a duty of confidentiality, and which was learned in connection with performance under the Agreement.
5.3. The contracting parties undertake not to release confidential information of the other contracting party to any third party in any form without its written consent, and to take all necessary steps to secure such information. Where consent is given to provide information to a third party, the disclosing contracting party undertakes to bind that third party to the same duty of confidentiality as applies to it under the Agreement.
5.4. The contracting parties undertake to instruct their employees, workers, affiliated or related persons, and any subcontractors to whom confidential information will be made accessible due to an objective need for the purposes of performance under this Agreement or the Client's operations, of the obligation to keep such information confidential.
5.5. The protection of confidential information does not apply in particular where:
5.5.1. the contracting party proves that the information is publicly available without it having caused such availability itself;
5.5.2. the contracting party proves that it had the information available before the date it was disclosed by the other contracting party, and that it did not obtain it unlawfully;
5.5.3. the contracting party receives written consent from the disclosing party to disclose the given information;
5.5.4. disclosure of the information is required by law or by a binding decision of the relevant state administration or self-governing body.
5.6. If either contracting party learns in a credible manner, or has reasonable grounds to suspect, that confidential information has been disclosed to an unauthorised person, it is obliged to inform the other contracting party of this fact.
5.7. The obligation of confidentiality — that is, not disclosing confidential information — is not limited in time and continues even after the termination of the cooperation and the validity of the Agreement.
5.8. The Client agrees that the Provider may anonymously make use of experience and insights gained during therapeutic sessions for the purposes of a narrative style of therapeutic work. This means that the therapist may work with anonymised stories, transcripts of conversations, processes and functional solutions from their therapeutic practice, and may pass these on further — whether in teaching, supervision, professional texts, media publications, or in work with other clients. For the purposes of this consent, publication is understood to mean any disclosure or use of the text, or a part or adaptation of it, in printed, electronic, audio, visual or audiovisual form, including in books, articles, interviews, podcasts, website texts and other media outputs. The Provider undertakes that, in any such use, it will consistently protect the Client's identity and all identifying details so that it is not possible to recognise the Client.
6. SANCTIONS AND TERMINATION OF THE AGREEMENT
6.1. If the Client is late in paying any amount under the Agreement (in particular the First Payment or Subsequent Payments), the Provider is entitled to a contractual penalty of 0.05% for each day of delay on the outstanding amount, and this contractual penalty does not extinguish any right to damages. If the delay exceeds 30 days, the Provider has the right to terminate the Agreement without notice, with effect from the date the notice of termination is delivered.
6.2. The Client is entitled to cancel an individual consultation appointment no later than 48 hours before it is due to take place, in writing (by e-mail) or via the booking system. In the event of timely cancellation, the Client has the right to arrange a new appointment. If the Client cancels an appointment later than 48 hours before it is due to take place, or fails to attend, that appointment is counted towards the number of consultations provided or offered under the Agreement (that is, as a consultation already used), and the Client has no right to a replacement appointment.
6.2.1. The Client is entitled to purchase any individual consultation beyond those included in the purchased programme separately, in accordance with the Provider's current price list available at https://www.lucierust.com/cs/prices.
6.2.2. Under VIP cooperation, the Client is entitled to a total of 5 (five) individual consultations over the duration of the basic programme (4 months) — on average, one consultation every 21 days. Within the booking system for individual consultations, the Provider is obliged to make at least one appointment available once every 21 days. If no appointment is available at a given moment, it is up to the Client, should they wish to book a consultation, to contact the Provider and request an available appointment; specific time slots cannot be guaranteed by the Provider, but may be arranged individually with the Provider. The entitlement to a consultation cannot be accumulated, nor claimed retroactively, if the Client did not, within the relevant 21-day period, notify the Provider that no appointment was available. The Client is thus guaranteed the right to one consultation every 21 days; more frequent use of consultations is possible only by mutual agreement and depending on the Provider's current availability.
6.3. If there is a repeated late cancellation of appointments or failure to attend on the Client's part under point 6.2, entitling the Provider to conclude that the Client in fact has no interest in the agreed individual consultations, the Provider has the right to withdraw from the relevant part of the Agreement, whereby consultations already used (that is, cancelled late or missed) are not included in any refund of funds paid to the Provider under the Agreement, to which the Client expressly agrees.
6.4. A contracting party that breaches its obligations under the Agreement relating to the protection of information under Article 5 of these Terms and Conditions is obliged to pay the other contracting party a contractual penalty of CZK 10,000 for each such breach. The same contractual penalty of CZK 10,000 is payable to the Provider also where the Client, in breach of point 4.2, makes available, shares, or in any way provides to a third party materials, works or content obtained in connection with the provision of the Services (in particular workbooks, recordings and other educational materials), for each individual instance of such a breach. Before applying either of the above contractual penalties, the contracting party is first obliged to call on the other contracting party to explain the circumstances of the breach, and only subsequently to apply the contractual penalty. This contractual penalty does not affect any right to damages.
6.5. Either contracting party has the right to withdraw from the Agreement if the other contracting party grossly (in particular in relation to confidentiality) or repeatedly breaches the terms of the Agreement, or acts contrary to good morals in connection with the Agreement. Withdrawal takes effect on the day written notice of withdrawal is delivered to the other contracting party. This does not affect the right to damages, contractual penalties or default interest under this Agreement. The contracting parties will not return performance already provided up to that point; the Provider is entitled to remuneration for Services provided up to the date the withdrawal takes effect and, if the provision of a service has not been completed, to a proportionate part of the agreed remuneration for that service. The Provider shall invoice for performance provided but not yet paid for within 15 days of the withdrawal taking effect.
6.6. The Provider has the right to withdraw from the Agreement where:
6.6.1. the Client's conduct is contrary to applicable legal regulations, good morals or the advertising code of ethics, or endangers public order;
6.6.2. the Client promotes a competitor of the Provider;
6.6.3. the Client's conduct is, in its content, quality or form, incompatible with the interests of the Provider;
6.6.4. the Provider has claims against the Client that are overdue, arising from legal relationships other than those arising from the Agreement;
6.6.5. the Client enters insolvency proceedings or liquidation.
7. DELIVERY AND OTHER ARRANGEMENTS
7.1. Electronic documents sent via the contact e-mail addresses stated in the Agreement, or communicated via such an address, are likewise considered to be in writing, and, in the case of the Provider, from the e-mail address info@lucierust.com or glowie@glowsome.com. This provision does not apply to documents leading to the termination of this Agreement.
7.2. The contracting parties are entitled to unilaterally change their contact e-mail addresses, but are obliged to notify the other contracting party of such a change in writing and demonstrably. Such a change is not grounds for concluding an amendment to this Agreement.
7.3. The Provider is entitled, in providing the Services, to make use of the services of third parties (subcontractors).
7.4. By concluding the Agreement, the Client consents to the publication of the Client's name, logo, samples of the Provider's outputs, or the address of the Client's website in the Provider's references, or as part of the Provider's promotional activities.

9. FINAL PROVISIONS
9.1. The meaning and content of words shown in italics is defined by the Agreement (and therefore also by these Terms and Conditions); unless the context clearly indicates otherwise, the meaning of a word in the singular also includes the plural and vice versa, and a word expressing a particular gender or grammatical case also includes other genders or cases. Headings are given for clarity only and do not affect the interpretation of the Agreement.
9.2. If one or more provisions of the Agreement prove to be invalid and/or ineffective and/or unenforceable in any way, the validity, effectiveness and/or enforceability of the remaining provisions shall not thereby be limited or impaired. Any such affected provision shall be replaced by another provision of this Agreement that is closest to it in meaning and purpose and, failing that, shall be interpreted in accordance with the overall meaning and intent of this Agreement.
9.3. The contracting parties acknowledge the collection, storage and processing of personal data (in particular first and last name, permanent residential address, and date of birth, contained in the Agreement) by the other contracting party (or its employees), for the purposes of maintaining records and property-related administration of the relevant contracting party, discussion within its bodies, and, subject to compliance with the terms of the Agreement and the law, publication of the decisions of such bodies, conclusion of agreements, etc., in which such data is contained. Personal data will be processed for an indefinite period, but no longer than until the purpose for which it is processed ceases to apply, subject to exceptions laid down by special legislation. The contracting parties are aware of their rights and obligations under Regulation (EU) 2016/679 (GDPR) and Act No. 101/2000 Coll., in particular in relation to the rights of data subjects. The relevant data subject may raise an objection to the processing of personal data with the relevant contracting party. The contracting parties undertake that personal data will be processed in accordance with the relevant legislation, in particular so as to prevent unauthorised processing and to ensure compliance with the principles of lawfulness, transparency and fairness. Personal data is handled in accordance with the principles published on the Provider's website, specifically at: www.lucierust.com
9.4. Matters not expressly regulated by the Agreement shall be governed by the Civil Code and other generally binding legal regulations of the Czech Republic.
9.5. Any changes and additions to the Agreement may only be made in the form of written, chronologically numbered amendments, with the consent of the contracting parties.
9.6. The Provider is entitled to change or supplement these Terms and Conditions at any time. The Provider is obliged to notify the Client of such a change no later than 15 days before the date it takes effect. In such a case, the Client is entitled to terminate the Agreement, subject to a notice period of 30 days. The notice of termination must be delivered no later than the day preceding the day the change takes effect. Until expiry of the notice period, these Terms and Conditions shall apply in their original wording.
These Terms and Conditions are valid as of 1 September 2026.
